SUBJECT: Resolution Regarding Consideration of Composition of Executive Council

WHEREAS, by Resolution dated April 12, 2004, the Executive Council approved the Proposed UAN Founding Constitution, which will be considered and voted upon by the delegates to the 2004 National Labor Assembly; and
WHEREAS, the Organizational Structure Committee (OSC) developed the full text of the Constitution, incorporating all necessary sections related to objectives, governance, dues, membership, membership protection, discipline, and other important areas, and has spent considerable time getting feedback, revising and educating constituents on these recommendations; and
WHEREAS, the OSC received an array of competing proposals on the composition and structure of the Executive Council, which ranged from maintaining the status quo to restructuring in various ways, including adding between two (2) and seven (7) additional Directors, adding Regional directors seats, and adding Directors from both small and large states; and
WHEREAS, the OSC conferred with the Executive Council and advisors to determine the appropriateness of changing the size of the Executive Council at this NLA; and
WHEREAS, both the OSC and Executive Council determined that there are many serious and complex issues involved in the various competing proposals concerning the composition of the Executive Council, including legal issues, factual issues involving the definition of a Region, the definition of ìsmall stateî and "large state," and significant budgetary issues; and
WHEREAS, the Executive Council previously sought to involve state E&GW collective bargaining leaders and seeks to promote their role in the UAN leadership decision making process; and
WHEREAS, given the large number of critically important issues involved in the Proposed Founding Constitution, the Executive Council agrees with the OSCís recommendation to maintain the current size and structure of the Executive Council, while studying the above-described and other options as to the future composition of the Executive Council;
NOW THEREFORE BE IT RESOLVED, that the Executive Council directs the OSC, beginning promptly after the adjournment of the 2004 NLA, to compile and evaluate the above described and additional options as to the composition of the Executive Council; and
BE IT FURTHER RESOLVED, that in evaluating various suggestions, the OSC consider the benefits of the various proposals to the UAN membership in both large and small states, the costs attendant to expansion, and any relevant legal issues; and
BE IT FURTHER RESOLVED, that the OSC report and make recommendations to the Executive Council on this issue no later than December 1, 2004, so that the Executive Council can report and make recommendations to the 2005 NLA. |
