SUBJECT: UAN Transition Under Revised Article VIII

WHEREAS, the UAN National Labor Assembly should provide for self-governing continuation in governance and transition under Article VIII of the ANA Bylaws, following adoption of proposed amendments by ANA.

THEREFORE BE IT RESOLVED that, pending the final approval of the UAN Constitution and Bylaws, Article VIII (as amended in 2001) as an interim governance document be applied in the following manner:

UAN Executive Council interpretation and application of Article VIII (as amended in 2001) as a transitional governing document be guided by Section 2 of Article VIII, as amended in 2002.

  1. Composition of UAN continue to be as provided in Article VIII, Section 2 (as amended in 2001) except that provision be made by the Executive Council for membership and participation at all UAN levels of any nurse members who are represented through UAN National Councils and are not also CMA members (e.g., situations where a geographically suitable UAN CMA is unable or unwilling to provide full collective bargaining member status to nurse members represented by UANBC or the UAN VA Council).
  2. The UAN national officers shall have the titles of President, Vice President, and Secretary-Treasurer. The UAN Program Director shall have the title of National Director and report to the UAN Executive Council, which shall have hiring, evaluation and termination authority.
  3. The UAN operating guidelines shall remain in effect, except as inconsistent with Article VIII, Section 2, as amended in 2002.
  4. The UAN Executive Council is authorized to reconcile issues concerning implementation of dues with ANA when the NLA is not in session.

BE IT FURTHER RESOLVED that the UAN Executive Council be charged with the preparation of a proposed Constitution and Bylaws to be presented to the National Labor Assembly no later than its 2003 regular meeting.
